Wake County does NOT require a permit to remove trees on residential property in unincorporated areas, except within Neuse Riparian Buffers (50 ft from streams) where most cutting requires NCDEQ buffer authorization. Inside cities, separate tree ordinances apply.
Wake County's UDO does not impose a residential tree-removal permit. The exception is the Neuse Riparian Buffer (15A NCAC 02B .0233) β within 50 ft of any perennial or intermittent stream, vegetation removal requires buffer authorization from NCDEQ Division of Water Resources. Cutting in the inner 30 ft is very limited; the outer 20 ft allows selective cutting if the canopy is maintained. Inside Raleigh, Cary, and other cities, tree ordinances may require permits for protected/significant trees in setback areas. Raleigh's TCO (Tree Conservation Ordinance) applies to lots over 2 acres in single-family residential.
Neuse Buffer violation: state penalty up to $25,000/day under NCGS Β§143-215.6A. Removing a tree without required Raleigh permit: civil penalty plus replacement requirement.
