When a city-owned street tree is authorized for removal, Newport Beach Municipal Code Chapter 13.09 requires replacement planting at a ratio determined by the Municipal Operations Director based on the size and species of the removed tree. Standard replacement is typically one-for-one for smaller trees and may increase to two-for-one or higher for large mature specimens. Replacement species must be selected from the city's approved street tree list, which includes species adapted to Newport Beach's coastal climate and soil conditions. Common approved replacement species include jacaranda, Brisbane box, New Zealand Christmas tree, and various palm species. For development projects, approved landscape plans must include replacement trees at ratios specified by the Community Development Department during plan review. Heritage trees that are approved for removal carry the highest replacement ratios, potentially three-for-one or greater, with replacement trees required to be a minimum 36-inch box size at planting. The city may also require a financial contribution to the city's urban forest fund in lieu of on-site replacement when the property cannot accommodate the required number of replacement trees. All replacement trees must be planted within six months of the removal unless weather conditions require an extended planting window. The property owner or developer is responsible for maintaining replacement trees for a minimum establishment period of three years, including watering, staking, and protection from damage.
Failure to plant required replacement trees within the specified timeframe is a code violation subject to administrative citations. Fines for non-compliance start at $250 and increase with continued violation. Developers who fail to complete replacement planting may have building occupancy withheld. Dead replacement trees must be replaced at the property owner's expense within 90 days of notice.
