Norfolk was among the first Virginia localities to substantially modernize ADU rules through its 2018 zoning ordinance rewrite, replacing the 1992 code. Under the current zoning ordinance, ADUs are permitted by right in R-1 through R-MF residential districts as detached (backyard cottage), attached (addition), or internal (basement, attic, or interior conversion) units. Maximum size is 900 square feet or 50 percent of the principal dwelling floor area, whichever is less. Maximum height generally matches accessory structure limits for the underlying district. Setbacks follow the principal-dwelling district rules; rear and side setbacks are typically 5-10 feet depending on district. The ADU must share a lot with an existing principal single-family dwelling. Permits required: zoning compliance review through City Planning; building permit through Codes Administration under the 2021 Virginia USBC (based on 2018 IRC with Virginia amendments); and trade permits for electrical, mechanical, and plumbing. Filing is through the City's online permitting portal. Properties within designated historic districts (Ghent, West Freemason, Colonial Place, Brambleton) require Architectural Review Board (ARB) approval before zoning permit issuance. Chesapeake Bay Preservation Act Resource Protection Area buffers (100 feet from tidal waters) restrict ADU placement on many waterfront and tributary-adjacent lots. FEMA flood zone construction (V and A zones) requires elevation per the Virginia USBC flood provisions.
Unpermitted ADU construction violates the Norfolk Zoning Ordinance enforcement provisions and is subject to civil penalties up to $1,000 under Va. Code Β§15.2-2286 and stop-work orders by Codes Administration. Failure to obtain Chesapeake Bay Act review can trigger DEQ and city stormwater enforcement. ARB violations in historic districts may require removal at owner expense.
