Fillmore Municipal Code (FMC) Chapter 6 requires building permits for carports as accessory structures. Carports must meet setback requirements of the underlying zone and cannot exceed lot coverage maximums. Open-sided carports under 200 sq ft attached to a residence may qualify for a simplified permit process through Community Development.
Carports are regulated as accessory structures under FMC Title 15 (Buildings and Construction) and the zoning code. In residential zones, carports must maintain required side and rear setbacks (typically 5 feet side, 5 feet rear in R-1 zones). Front-yard carports are generally not permitted. Metal carports and fabric canopies are subject to the same permit requirements as permanent structures. Carports must be designed to withstand wind loads per California Building Code. The structure counts toward maximum lot coverage calculations for the zone.
Building a carport without a permit is a code violation subject to stop-work orders from Community Development at (805) 524-1500 ext 234. Unpermitted structures must be brought into compliance through retroactive permitting or removal. Fines may be assessed under the city's administrative citation program.
