Under California Building Code Title 24, Chapter 31, and the Swimming Pool Safety Act (Health & Safety Code Β§115920-115929), all residential swimming pools in Fillmore must have an enclosure barrier at least 60 inches (5 feet) high. Gates must be self-closing and self-latching with the latch at least 54 inches above grade. Gate openings must not allow passage of a 4-inch sphere. In addition to the barrier, at least one additional safety feature is required: an approved safety cover, pool alarm, self-closing/self-latching doors with alarms from the residence to the pool, or other approved device. Fillmore building inspectors verify compliance during pool permit inspections. Existing pools that change ownership trigger disclosure requirements.
Non-compliant pool barriers are a serious safety violation. Building inspectors may issue correction notices during inspections. The city can require immediate remediation of inadequate pool barriers. Failure to comply with the Swimming Pool Safety Act can result in civil liability if a drowning or injury occurs.
