Under California Building Code Section 3109 and the Simi Valley Building Code, all residential swimming pools, spas, and hot tubs must be enclosed by a barrier at least 60 inches (5 feet) in height. Gates must be self-closing and self-latching with the latch at least 54 inches from grade. The barrier must not have openings that allow a 4-inch sphere to pass through. Horizontal members that could serve as footholds must be spaced to prevent climbing. Doors from the house that open directly to the pool area must have self-closing devices and alarms. New pools require an approved safety feature per California Health and Safety Code 115922, which may include a pool fence, safety cover, door alarms, or self-closing doors.
Non-compliant pool barriers are a serious safety violation. The Building Division may issue immediate correction notices. Fines start at $250 and increase for non-compliance. Properties with pools that lack required barriers may not pass resale inspections. Drowning incidents involving non-compliant barriers may result in criminal liability.
