Tiny home rules in Lancaster County, NE β covering tiny houses on wheels (THOWs), park model RVs, and tiny home on foundation builds β determine where they are legal and how they get permitted.
Lincoln has no tiny-home-specific ordinance. A tiny house used as a second unit is an accessory dwelling, capped at 800 square feet and one bedroom with owner occupancy, and must sit on a permanent foundation. A tiny house on wheels is treated as a recreational vehicle, not a permanent home.
Lincoln's zoning code does not define 'tiny home,' so a tiny house is regulated by how it is used. As a stand-alone second dwelling it is an accessory dwelling under Lincoln Municipal Code Section 27.62.040(c): allowed only in R-1 through R-4, no larger than the lesser of 40% of the main house or 800 square feet, one bedroom, owner occupancy, shared utilities, and a recorded deed restriction. It must meet the Lincoln building code, which requires a permanent foundation and utility hookups. A tiny house on a chassis and wheels is a recreational vehicle and cannot be occupied as a permanent residence outside a licensed RV park. Unincorporated acreages follow the Lancaster County Zoning Resolution.
Living in a tiny home that does not meet the accessory-dwelling standards, or parking a tiny-house-on-wheels as a permanent residence, is a zoning violation enforced by Lincoln Building and Safety.
