Nebraska permits consumer fireworks only within statutory windows, and the state limits retail sale to June 24-July 5 and December 28-January 1. Lincoln narrows discharge to July 3 (8 a.m.-11 p.m.) and July 4 (8 a.m.-11:59 p.m.) only. New Year's fireworks are banned in Lincoln.
Lincoln Municipal Code 9.44.080 makes it unlawful to sell or discharge permissible fireworks except 8 a.m.-11 p.m. July 3 and 8 a.m.-11:59 p.m. July 4 each year, so Lincoln does NOT allow the December/New Year window that state law otherwise opens. Bottle rockets, skyrockets, and helicopter-type devices are banned outright (LMC 9.44.070). Fireworks may not be discharged from vehicles, onto streets or sidewalks, at people, or onto another's property without permission (LMC 9.44.100). Statewide, retail sale is limited to June 24-July 5 and December 28-January 1 (Neb. Rev. Stat. 28-1249). Unincorporated Lancaster County follows the state window; individual villages may set their own days.
Violation of LMC 9.44.010-9.44.100 is a misdemeanor punishable by a fine of not less than $100.00 nor more than $500.00 (LMC 9.44.020).
