Nebraska's Noxious Weed Control Act makes every landowner responsible for controlling noxious weeds. The Lancaster County Weed Control Authority enforces the Act and can order control or do the work and bill the owner.
The state framework is the Noxious Weed Control Act, Neb. Rev. Stat. 2-945.01 to 2-966. It imposes an affirmative duty: 'It shall be the duty of every person to control the spread of noxious weeds on lands owned or controlled by him or her and to use such methods for that purpose as are specified in rules and regulations adopted and promulgated by the director' (2-952). The Lancaster County Weed Control Authority administers the Act countywide, files an annual control plan, and issues individual notices. Separately, Lincoln's LMC 8.46 handles ordinary tall grass and worthless vegetation over six inches.
If an owner fails to control noxious weeds after notice, the control authority may enter, control the weeds, and assess the cost against the property as a lien.
