Westchester County cannot ban dogs by breed. NY Agriculture & Markets Law Β§107(5) preempts all breed-specific legislation statewide. Dangerous-dog designation is case-by-case under Β§123.
NY Agriculture & Markets Law Β§107(5) prohibits any municipality or county from enacting breed-specific dog restrictions. Westchester County and its 45 municipalities can only regulate individual dogs through the dangerous-dog process under Β§123, which requires a judicial finding after a bite or threat. No breed (pit bull, Rottweiler, etc.) is banned in Westchester County.
