ARS Β§11-1025 uses a behavior-based standard for declaring dogs dangerous or vicious, regardless of breed. Any dog that bites or acts aggressively may be subject to a dangerous dog hearing through the justice court system. MCACC investigates bite incidents in unincorporated areas. There is no statewide preemption of breed-specific legislation, but Maricopa County has not enacted any. HOA CC&Rs in planned communities commonly restrict certain breeds (pit bulls, Rottweilers, etc.) or impose weight/size limits through insurance liability clauses. These HOA restrictions are enforceable as private contractual obligations.
