FL Statute ยง399 governs elevator safety statewide, administered by the Florida Department of Business and Professional Regulation (DBPR) Bureau of Elevator Safety. All elevators, escalators, dumbwaiters, and platform lifts must be registered and inspected annually by a DBPR-certified inspector. Five-year full-load safety tests required. Certificates of Operation must be posted inside the elevator cab. Only licensed elevator contractors may perform installation, alteration, or repair. Residential elevators in single-family homes are also regulated. Private residence exemption does not apply in Florida; all permanent elevators must be permitted and inspected.
Operating without Certificate of Operation: DBPR fines 250 to 5,000 dollars per violation. Unlicensed work: misdemeanor under FL ยง399.07. Failed inspection: elevator taken out of service until repaired.
