Napa does not have its own lead-paint ordinance; lead-based paint compliance follows the federal Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X) and the EPA Renovation, Repair, and Painting (RRP) Rule for pre-1978 housing, plus California Department of Public Health requirements administered by Napa County Public Health. Pre-1978 sale and lease disclosures are mandatory.
Older Napa neighborhoods β including Old Town, Fuller Park, Alta Heights, Calistoga Avenue, downtown Napa, and the Soscol corridor β contain housing stock built before 1978 that is presumed to contain lead-based paint unless tested. Three federal and state regimes apply. (1) Disclosure under Title X Section 1018: Before signing a sale contract or new residential lease for a pre-1978 dwelling, the seller or landlord must disclose any known lead-based paint or hazards, provide all available records, deliver the EPA 'Protect Your Family From Lead in Your Home' pamphlet, include the federal Lead Warning Statement, and (for sales) provide a 10-day inspection opportunity. (2) EPA RRP Rule: Any contractor performing renovation, repair, or painting that disturbs more than 6 square feet of interior or 20 square feet of exterior painted surface in a pre-1978 home or child-occupied facility must be EPA Lead-Safe Certified, follow lead-safe work practices (containment, dust control, cleanup, verification), and provide the 'Renovate Right' pamphlet to the owner or occupant. (3) State: The California Department of Public Health's Childhood Lead Poisoning Prevention Branch and CDPH-accredited inspectors handle abatement; testing and abatement by certified personnel is required where a lead hazard is identified. Building permits issued by the Napa Building Division for renovation work do not waive RRP obligations.
Failure to deliver the Title X disclosure to a buyer or tenant of a pre-1978 dwelling can trigger HUD and EPA civil penalties up to $20,485 per violation (as adjusted) and treble damages in private suits. Contractor RRP violations carry EPA civil penalties up to $40,000-plus per day per violation as adjusted, plus state contractor-license discipline. The Napa Building Division will not issue a final inspection if work performed in a pre-1978 home generated visible lead-dust hazards that have not been cleaned up under RRP.
