Phila. Code ยง6-800 (originally 2011, expanded by Bill 180936-A to cover all pre-1978 rentals by October 2020) requires owners of pre-1978 rental units to obtain a lead-safe or lead-free certification from an EPA-certified risk assessor and file with Phila. Department of Public Health before leasing. Certifications valid 2 years (lead-safe) or 4+ years (lead-free). Tenants must receive EPA pamphlet Protect Your Family from Lead and sign disclosure. Federal Title X (42 U.S.C. ยง4852d) sets baseline. Philadelphia Lead Court adjudicates violations.
Failure to certify: 2000 dollars per unit per rental period plus tenant rescission right and treble damages if child harmed.
