Milpitas Zoning Ordinance Table B.4.030-A caps single-family R1 primary buildings at 30 feet and accessory buildings at 15 feet. Multi-family zones allow more: R2 up to 30 ft / 2.5 stories, R3 up to 35 ft / 3.5 stories, and R4 up to 60 ft / 4 stories. Height is measured to the roof midpoint for sloped roofs.
Maximum building heights in Milpitas are listed by zone in Table B.4.030-A (Residential Zones Development Standards) and parallel tables for other districts. In the Single-Family (R1) zone, primary buildings are limited to a maximum of 30 feet, and accessory buildings to 15 feet, across all R1 sublots (R1-10 through R1-2.5). Multi-family and mixed zones allow greater height: the R2 zone permits up to 30 feet and 2.5 stories for primary buildings, R3 up to 35 feet and 3.5 stories, R4 up to 60 feet and 4 stories, and the MHP (mobile-home park) zone up to 35 feet and 3 stories; accessory-building height in those zones generally ranges from 15 to 25 feet. Where the standard lists both a foot limit and a story limit, the building must comply with both. Height is measured under Subsection A.6.090 as the vertical distance from finished grade adjacent to the building to the highest point on the roof; for a sloped, gable, hipped, or gambrel roof, height is measured to the midpoint between the ridge and where the eave meets the wall. Certain features (skylights, chimneys, decorative spires, elevator/stair towers, and screened mechanical equipment) may project above the height limit subject to the limits in Table C.2.050-A, provided no habitable area is above the limit. The 'H' Hillside Combining District uses a different height-measurement and limit scheme under Chapter B.22.
Exceeding the applicable height limit for your zone, or adding habitable space above the limit, can block permit approval and require redesign; unpermitted over-height construction can be cited and ordered modified.
