Under the 2023 amendments to Tennessee's Hemp-Derived Cannabinoid Act (TCA 39-17-451 et seq.), retailers selling Delta-8, Delta-10, and similar products by mail or delivery must verify buyer age of 21 or older at both purchase and delivery. Products must be in child-resistant packaging, labeled with THC content, and accompanied by certificates of analysis. The Tennessee Department of Agriculture licenses sellers and the Tennessee Alcoholic Beverage Commission has expanded enforcement authority. Marijuana itself cannot be delivered in any form. Memphis does not operate a separate cannabis delivery permit because no marijuana retail exists, and home occupation permits cannot be used to ship hemp products without state licensing.
Delivering hemp products to anyone under 21, shipping without state license, or delivering marijuana can result in product seizure, license revocation, and criminal penalties including felony charges for marijuana.
