Tennessee law prohibits all personal marijuana cultivation regardless of quantity. Growing even one plant is a felony under TCA 39-17-417. Memphis residents cannot legally cultivate marijuana indoors or outdoors for any purpose.
Tennessee Code Annotated 39-17-417 makes the manufacture of a Schedule VI controlled substance, including marijuana, a Class E felony at minimum. Cultivation of 10 or more plants escalates to Class D felony, and 20 to 99 plants is Class C felony. There is no medical, recreational, personal, or caregiver exemption. Hemp cultivation is permitted only under a Tennessee Department of Agriculture commercial license (TCA 43-27-201) and is limited to Cannabis sativa L. with under 0.3% Delta-9 THC. Memphis residents who want to grow CBD or hemp for personal use are not authorized; the state hemp program only licenses commercial growers, and possession of marijuana plants triggers state and federal exposure.
Growing any marijuana plant in Memphis is a Class E felony under TCA 39-17-417, punishable by 1 to 6 years imprisonment and fines up to $5,000. Larger grows escalate sentencing significantly.
