New York's Marijuana Regulation and Taxation Act (MRTA, 2021) established a state licensing framework administered by the Office of Cannabis Management (OCM) and gave municipalities a one-time opt-out window ending December 31, 2021. Decisions were binary per license type (retail vs. on-site consumption). The City of Schenectady opted in for both retail dispensaries and on-site consumption, and dispensaries now operate within commercial zoning districts subject to a 500-foot buffer from schools and a 200-foot buffer from houses of worship (NY Cannabis Law §72). Several Schenectady County towns - including Niskayuna and Glenville - opted out of retail sales but may hold a public referendum to reverse that decision. Rotterdam opted in. Duanesburg and Princetown largely opted out given rural character. Opted-out municipalities still receive state cannabis tax revenue sharing reduced accordingly. OCM's state license limits are separate from local zoning, and dispensaries must also meet site plan review under each municipality's planning process.
