Because cannabis remains a Schedule I controlled substance under SC Code Title 44, Chapter 53, there is no licensing pathway for medical or recreational dispensaries. No state agency issues retail licenses for marijuana products. Some retailers operate selling federally legal hemp-derived products such as CBD and Delta-8 within limits set by SC Code 46-55-10 (Hemp Farming Act), but these are not cannabis dispensaries. Cities cannot create zoning districts permitting marijuana retail since no underlying state license exists, and operating without a license is a felony distribution offense.
Distribution of marijuana is a felony. First offense: up to 5 years and $5,000 fine. Subsequent offenses and larger amounts trigger mandatory minimums up to 30 years under SC Code 44-53-370.
