North Charleston caps short-term rental occupancy at two persons per bedroom up to a maximum of eight persons (including children), with stays limited to twenty-nine consecutive days, under Section 4-21 of Appendix A (Zoning Regulations) of the Code of Ordinances.
Under Ordinance 2023-022 (codified at Section 4-21 of Appendix A, Zoning Regulations of the City of North Charleston Code, effective January 1, 2023), a short-term rental is defined as a dwelling unit intended to provide temporary sleeping accommodations for no more than two persons per bedroom, up to a maximum of eight persons (including children), for a period not to exceed twenty-nine consecutive days per rental. The maximum occupancy must be visibly posted inside the unit and included in any advertising, and operators must limit the number of guests on-site at any time to that posted figure. The STR Permit also requires a minimum of one off-street or allocated parking space for each two bedrooms rented, with a maximum of four spaces allocated to the unit. Permits are capped at sixty per City Council district (with room rentals in owner-occupied dwellings exempted from the cap), and Districts 5, 8, and 10 have at times been at capacity.
Operating an STR over the bedroom-based occupancy cap, exceeding the eight-person ceiling, or failing to post the maximum occupancy is a violation enforceable by the Department of Planning, Preservation & Sustainability and may result in revocation or non-renewal of the STR Permit. More than three notices of violation in a one-year period also disqualifies an applicant from holding or renewing a permit.
