Under Washington state law, Initiative 502 (I-502) passed in 2012 legalized possession of small amounts of recreational marijuana for adults 21 and over, but it did not legalize home cultivation. Unlike Colorado, Oregon, California, or Nevada, Washington remains one of the few legal states where recreational home-growing is still prohibited, and Auburn follows state law. Auburn City Code does not authorize residential recreational cultivation either. The only narrow home-cultivation exception is for qualifying medical marijuana patients registered under RCW 69.51A who have been authorized by a healthcare professional: such patients may grow a limited number of plants (generally four to fifteen depending on registration status) for personal medical use, and cooperatives of up to four registered patients may jointly grow a limited total. Landlords can still prohibit cannabis cultivation on their property, and HUD-subsidized housing prohibits marijuana possession and cultivation regardless of state law. Any unauthorized grow is a felony under RCW 69.50.401 with increased penalties based on quantity, proximity to schools, and other factors. Auburn zoning does not permit commercial marijuana producers, processors, or retailers within city limits under a long-standing ACC Title 18 prohibition on cannabis businesses. Odor, electrical load, and mold concerns from illegal grows can trigger code enforcement, fire marshal inspection, and police response.
Unauthorized manufacture or cultivation of cannabis is a Class B or C felony under RCW 69.50.401 with fines up to 25,000 dollars and prison time based on plant count. Medical patients exceeding RCW 69.51A plant limits lose their affirmative defense.
