Home cultivation of recreational cannabis is illegal in Federal Way and throughout Washington under I-502 and RCW 69.50. Qualifying medical patients may grow up to 6 plants at home under RCW 69.51A.
Washington was the first state to legalize recreational adult-use cannabis via Initiative 502 in 2012, but it is also one of the only legalization states that does not allow home grow for non-medical users. Under RCW 69.50.401, producing (growing) cannabis without a state producer license from the Washington State Liquor and Cannabis Board (WSLCB) is a felony offense. This means a Federal Way resident over 21 who grows even a single plant for personal use commits a felony unless they qualify as a medical patient. Under the Washington Medical Use of Cannabis Act, RCW 69.51A, a patient with a valid medical authorization from a qualifying provider and registered in the state medical cannabis database may grow up to 6 plants for their own use (or up to 15 plants with a higher authorization) and may possess up to 8 ounces of usable cannabis. Medical plants must be grown indoors or in a secure outdoor structure not visible from the street or a public place. Federal Way does not add local home-grow regulations beyond state law, so state law controls. Recreational users can legally purchase up to 1 ounce of usable cannabis, 16 ounces of solid infused product, 72 ounces of liquid infused product, or 7 grams of concentrate from state-licensed retailers, though Federal Way has banned retail within city limits (see dispensary zoning). Legislative proposals to allow limited recreational home grow have not passed as of 2025. Call the WSLCB at 360-664-1600 with cannabis questions.
Unlicensed cannabis production is a Class C felony under RCW 69.50.401 with up to 5 years imprisonment and 10,000 dollars fine. Over 40 plants is a Class B felony with up to 10 years. Medical patients exceeding plant limits lose state protection.
