Home cultivation is prohibited under Mississippi's Medical Cannabis Act (Senate Bill 2095, 2022). Only licensed cultivators grow cannabis. Patient home grow is not allowed. Recreational cannabis remains a felony.
The Mississippi Medical Cannabis Act (Miss. Code Β§Β§ 41-137-1 et seq.) legalized medical cannabis following the 2022 legislative override of Initiative 65's judicial invalidation, but unlike many states it does NOT authorize patient home cultivation. All cannabis sold in Mississippi must come from licensed cultivators regulated by the Mississippi Department of Health. Hinds County has no local home-grow allowance - and could not create one, as Dillon's Rule prevents cities from expanding cannabis access beyond state law. Recreational cannabis possession over 30 grams remains a felony under Miss. Code Β§41-29-139. Hinds County ordered a local opt-out moratorium when dispensary rules rolled out; individual municipalities (Jackson, Clinton, Byram, Raymond) made separate opt-in/opt-out decisions by May 2022 deadline.
