Home cultivation of cannabis is illegal in Texas and in Lubbock. Growing marijuana is a state jail felony or higher depending on quantity. Only licensed dispensaries under the TX Compassionate Use Program may cultivate low-THC cannabis.
Texas Health and Safety Code Chapter 481 prohibits cultivation of marijuana as manufacture of a Schedule I controlled substance. Cultivating any amount is at minimum a state jail felony (180 days to 2 years) with penalties escalating by weight: under 50 lbs second-degree felony, 50 to 2000 lbs first-degree felony, and over 2000 lbs life felony. Medical home cultivation is not permitted even for patients registered under the Texas Compassionate Use Program; only licensed dispensing organizations may grow low-THC cannabis. Lubbock Police and DPS Narcotics actively enforce cultivation laws. Federal law also prohibits cultivation as a Schedule I offense. Hemp (under 0.3% delta-9 THC) cultivation is legal only with a Texas Department of Agriculture license.
