Texas does not have legal recreational cannabis. The Texas Compassionate Use Program (TCUP), under TX Health and Safety Code Chapter 487 and administered by the Department of Public Safety, licenses a limited number of dispensing organizations (currently three) to cultivate, process, and dispense low-THC cannabis (originally 0.5% THC, expanded to 1.0% THC by 2023 legislation) to patients with qualifying conditions including epilepsy, PTSD, cancer, autism, and terminal illness. Dispensing organizations may deliver to patients statewide and may operate satellite pickup locations. Lubbock has no local ordinance authorizing recreational dispensaries because they are state-illegal. Zoning for a TCUP satellite location would require compliance with standard pharmacy or medical use zoning. CBD retailers selling federally compliant hemp (under 0.3% delta-9 THC) are allowed as general retail.
