New York Cannabis Law Β§222 (Marihuana Regulation and Taxation Act, signed March 31, 2021) authorizes adults 21+ to cultivate up to three mature and three immature cannabis plants at their private residence, capped at six mature and six immature plants per household regardless of the number of adults living there. Plants must be kept within a secure location and cannot be visible from a public place β a cannabis plant on an unscreened front lawn or visible through a ground-floor window facing the street can trigger enforcement. New Rochelle's municipal code (eCode360) does not impose local cultivation restrictions, so the MRTA baseline controls. Landlords may prohibit cultivation in lease agreements. Note that cultivation for sale without a NY Office of Cannabis Management (OCM) license remains a crime under Cannabis Law Β§125.
Growing over the household limit, cultivating while under 21, or sale without an OCM license is a violation of NY Cannabis Law with civil fines and possible criminal charges for commercial-scale operations. Visible plants can draw a summons for public display.
