New York State Uniform Code Appendix G governs all residential pool barriers. Requirements: fence at least 48 inches above exterior grade; bottom gap no more than 2 inches; chain link mesh no larger than 2ΒΌ inches; gates must be self-closing and self-latching, opening outward (away from the pool), with latch release at least 40 inches above grade; a temporary 48-inch barrier is required during construction, replaced by a permanent fence within 90 days of pool completion. NY Executive Law Β§387(14) requires a pool alarm on any pool constructed or substantially modified after December 14, 2006.
Barrier violations carry fines up to $5,000 and/or 15 days per day of violation under NYS Uniform Code penalty provisions. Missing or noncompliant alarm signage draws $500 first-offense and $1,000 subsequent fines.
