All residential pools must have a barrier at least 48 inches high with self-closing, self-latching gates per NYS Residential Code Appendix G. A pool alarm is required for pools built or substantially modified after Dec 14, 2006.
NYS Residential Code Appendix G (effective May 12, 2020) requires: barrier minimum 48 inches above grade, gates self-closing and self-latching opening away from the pool with latches 40+ inches high, max 2-inch bottom gap, chain-link mesh max 2.25 inches, and a temporary 48-inch barrier during construction replaced by a permanent one within 90 days. NY Executive Law Sec. 387(14) and 19 NYCRR Sec. 1228.2 require ASTM F2208 pool alarms on pools built/modified after Dec 14, 2006.
Fines up to $5,000 per day of violation; alarm signage violations carry $500 first offense and $1,000 subsequent.
