Cannabis cultivation is fully illegal in Kansas. Wichita follows Kansas state law, which prohibits the growing, possession, and use of marijuana for any purpose including medical. There is no home cultivation allowance.
Under Kansas Statutes K.S.A. 21-5706, cultivation of any amount of marijuana is a felony. Growing even one plant is classified as cultivation with intent to distribute. Kansas has no medical marijuana program and no recreational legalization. Wichita passed a local ordinance in 2015 reducing penalties for first-time marijuana possession to a fine, but cultivation remains a state-level felony offense not affected by local ordinances.
Cultivation of marijuana is a drug severity level 3 felony under Kansas law, punishable by up to 46 months in prison and fines up to $100,000 for a first offense. Subsequent offenses carry harsher penalties. Wichita's reduced local penalties apply only to simple possession of small amounts, not cultivation.
