Unlike states such as Missouri or Illinois, Kentucky's medical cannabis statute (KRS Chapter 218B, effective January 2025) does not permit qualifying patients or caregivers to cultivate cannabis at home. Only state-licensed cultivators operating under OMC licensure may legally grow cannabis in Kentucky. Possession of even a single live plant by an unlicensed person remains a controlled substance offense under KRS Β§218A.1422 (marijuana possession) or KRS Β§218A.1423 (cultivation). Louisville Metro Police Department enforces these provisions, and federal subsidized housing is also bound by federal cannabis prohibitions.
Unlicensed cultivation of fewer than five plants is a Class A misdemeanor; five or more plants is a Class D felony under KRS Β§218A.1423, plus potential federal housing consequences.
