Tyler no longer has an enforceable juvenile curfew. Texas House Bill 1819, effective September 1, 2023, bars every Texas city and county from adopting or enforcing a curfew on anyone under 18, except during a declared emergency.
Tyler enforced a nightly juvenile curfew for decades, but Texas House Bill 1819 ended that authority statewide. The law added Section 370.007 to the Local Government Code, providing that a political subdivision may not adopt or enforce an order, ordinance, or measure imposing a curfew to regulate the movements of persons younger than 18. The only exception is a curfew implemented under Chapter 418, Government Code, for emergency management. Police can no longer cite a minor simply for being out late, and Tyler's former curfew ordinance is unenforceable. Parents remain responsible for supervising their children, and other laws, such as trespass, still apply.
There is no curfew violation to enforce. Police cannot detain or cite a minor for being out at night unless another law is broken or a declared emergency curfew is in effect.
