There is no data center moratorium in unincorporated Maricopa County. On May 7, 2026, the Board of Supervisors approved Project Baccara โ two data centers and a gas power plant on 160 acres at Olive Avenue and Litchfield Road near Luke Air Force Base โ on a 4-1 vote, over roughly 440 opposition emails. Supervisor Thomas Galvin noted the site was 'already zoned industrial.' The only statewide brake is a budget deal effective July 1, 2026 that pauses the data center transaction-privilege-tax exemption through 2029; Governor Hobbs stressed it is not a construction moratorium. New facilities may still be built and approved.
No moratorium means no moratorium-based penalties. Data centers must still meet IND-2 or IND-3 zoning, obtain building permits, and comply with Noise Ordinance P-23; zoning or permit violations trigger standard county code-enforcement action.
