While Ohio HB 494 (2018) directly preempted local minimum wage, its broad reach and political climate effectively halted Cleveland's 2018 paid sick leave proposal that would have required one hour of leave per 30 hours worked. No current Cleveland Codified Ordinance compels private employers to provide paid sick days, paid family leave, or vacation. Public employees of the City of Cleveland and Cuyahoga County receive leave under their respective civil service rules and union contracts. Federal Family and Medical Leave Act provides unpaid job-protected leave for qualifying employers of 50 or more workers.
Because no ordinance mandates private paid leave, the city imposes no penalties. FMLA violations are pursued through the U.S. Department of Labor Wage and Hour Division.
