The Healthy Families and Workplaces Act, codified at CRS 8-13.3-401 et seq., requires employers to provide one hour of paid sick leave per 30 hours worked, up to 48 hours per year. Public health emergency leave provides additional hours. The Paid Family and Medical Leave Insurance program (FAMLI), under CRS 8-13.3-501, provides up to 12 weeks of partial wage replacement funded by employer and employee premiums. Local governments may adopt additional leave protections. Both programs apply to most public and private employers regardless of size with limited exceptions.
Employers face administrative penalties including back pay, fines up to $500 per violation, and possible private suits with attorney fees and double damages.
