NYC Fair Workweek, codified at Administrative Code chapter 12, requires fast-food and retail employers to post schedules 14 days in advance, pay premiums for last-minute changes, and offer extra hours to existing fast-food employees before hiring new staff.
Local Law 99 of 2017 created NYC Fair Workweek, codified at Admin Code chapter 12 sections 20-1201 through 20-1252 and enforced by DCWP. Retail employers with 20 or more employees citywide must post schedules at least 72 hours in advance and may not require on-call shifts. Fast-food chains with 30 or more locations nationwide must give 14 days advance schedule notice, pay $10 to $75 premiums per change, offer extra hours to current employees before hiring, and provide just-cause protection from discharge under Local Law 1 of 2021. The 2024 amendments extended coverage to delivery apps under Local Law 7 of 2024.
Fair Workweek violations under Admin Code section 20-1207 carry civil penalties of $500 to $1,000 per worker per violation, restitution for lost premiums, and reinstatement remedies; just-cause discharge violations trigger arbitration and possible reinstatement with back pay.
