Lincoln is an inland Sacramento-metro city in Placer County, approximately 90 miles from the Pacific Ocean. The California Coastal Act of 1976 (Pub. Res. Code §30000 et seq.) does not apply, and no California Coastal Commission Coastal Development Permit (CDP) is required for development in Lincoln.
The California Coastal Act, codified at Public Resources Code §30000 et seq., established the California Coastal Zone — a strip of land extending generally from the seaward limit of state jurisdiction inland to roughly 1,000 yards from the mean high tide line in developed urban areas and up to five miles in rural areas (PRC §30103). The Coastal Zone is mapped by the California Coastal Commission and covers only the 15 coastal counties (San Diego, Orange, Los Angeles, Ventura, Santa Barbara, San Luis Obispo, Monterey, Santa Cruz, San Mateo, San Francisco, Marin, Sonoma, Mendocino, Humboldt, Del Norte). Placer County is an inland Sierra-foothill / Sacramento Valley county and is not on the Coastal Commission's list of jurisdictions; no portion of Placer County lies within the Coastal Zone. Lincoln (approximate coordinates 38.89°N, 121.29°W; ~155 ft elevation) is approximately 90 miles inland from the Pacific. Coastal Development Permits, Local Coastal Programs, and the Coastal Act's chapter 3 development policies therefore do not apply. Shoreline / waterway projects in Lincoln are instead regulated through floodplain rules (LMC Chapter 15.32), Clean Water Act §404 wetland fill permits administered by the U.S. Army Corps of Engineers (Sacramento District), and §401 water quality certifications issued by the Central Valley Regional Water Quality Control Board.
No local coastal-development violations apply because the city is outside the Coastal Zone. However, unpermitted work in wetlands or waters of the United States within Lincoln can still trigger federal Clean Water Act §404 enforcement (up to $66,712 per day per violation under 33 U.S.C. §1319 and 40 CFR §19.4 as inflation-adjusted) plus state Porter-Cologne Act penalties under Water Code §13385 (up to $10,000 per day plus $10 per gallon over 1,000 gallons).
