San Leandro is NOT under California Coastal Commission jurisdiction (which covers the Pacific outer coast). Instead, the City's San Francisco Bay shoreline falls under the San Francisco Bay Conservation and Development Commission (BCDC), which regulates fill, dredging, and substantial use changes within 100 feet inland of the Bay shoreline under the McAteer-Petris Act (Gov. Code §66600 et seq.).
BCDC's jurisdiction includes the Bay itself and a 100-foot shoreline band along the entire San Francisco Bay shoreline, including San Leandro's approximately 950 acres of publicly owned shoreline. Any placement of fill, extraction of materials, or substantial change in use of land, water, or structure within this band requires a BCDC permit. BCDC issues permit decisions within 90 days of a complete application, weighing project benefits (such as enhanced public access compatible with wildlife) against environmental and economic detriment. San Leandro projects must also comply with the San Francisco Bay Plan and Bay Area Sea Level Rise policies. The Monarch Bay Shoreline Development (~75 acres) has been working through BCDC Design Review Board approval; the BCDC DRB recommended the City's park design proceed to the full BCDC Board on August 7, 2023. Locally, shoreline development is also subject to SLMC zoning (Title 5) and CEQA review.
Unpermitted fill or development within BCDC's 100-foot band is enforceable by BCDC under Gov. Code §66641.5 with administrative civil penalties up to $30,000 per violation plus $6,000 per day of continuing violation. BCDC may also order removal of fill at the owner's expense. Local violations under San Leandro zoning are separately enforceable.
