Chapter 3-15 declares any discharge to the municipal separate storm sewer system (MS4) other than stormwater unlawful, except for specifically enumerated conditional discharges such as residential car washing, dechlorinated pool/spa water, foundation drains, AC condensate, and incidental landscape irrigation runoff. Industrial and commercial sites must implement Best Management Practices. Per California SB 205 (effective January 1, 2020), regulated businesses must demonstrate enrollment in a National Pollutant Discharge Elimination System (NPDES) industrial stormwater permit when obtaining or renewing a San Leandro business license. New and redevelopment projects must comply with Provision C.3 of the Bay Area MRP (Order R2-2022-0018), including post-construction treatment, hydromodification controls where required, and Stormwater Control Plans reviewed by the City Engineer.
Violations are enforceable as municipal code infractions/misdemeanors. The City may issue notices of violation, stop-work orders, and administrative citations; clean-up and abatement costs may be assessed as liens. Knowing illegal discharges can also trigger State Water Board enforcement under the federal Clean Water Act and California Water Code with civil penalties up to $10,000 per day per violation (Water Code §13385).
