FEMA flood zone rules in San Leandro, CA β also called floodplain regulations or special flood hazard area (SFHA) rules β determine flood insurance requirements and elevation standards for new construction.
San Leandro is a participating community in the National Flood Insurance Program (NFIP). Floodplain management is codified in San Leandro Municipal Code (SLMC) Title 7, Chapter 7-9 (originally adopted by Ordinance 99-07). FEMA's December 21, 2018 Coastal Flood Insurance Rate Map (FIRM) revision identifies Special Flood Hazard Areas (Zone AE and Zone X) along the San Francisco Bay shoreline, the San Leandro Marina, San Lorenzo Creek, and Estudillo Canal.
SLMC 7-9 incorporates the FEMA Flood Insurance Study and accompanying FIRMs by reference as the basis for establishing Areas of Special Flood Hazard (SFHA). Within Zone AE the Base Flood Elevation (BFE) is the 1-percent-annual-chance (100-year) flood elevation; the City's floodplain ordinance requires the lowest floor (including basement) of new construction and substantial improvements to be elevated to or above the BFE, certified by a registered engineer or land surveyor via a FEMA Elevation Certificate. The 'substantial improvement / substantial damage' rule (50% of pre-improvement or pre-damage market value over any 12-month period) triggers full SFHA compliance, including elevation, flood-resistant materials below BFE, and anchoring against hydrodynamic and hydrostatic loads. All federally-backed mortgages on Zone AE parcels require flood insurance. The City of San Leandro's Building & Safety Division (510-577-3420) is the designated Floodplain Administrator and reviews permits, issues Elevation Certificates on file, and maintains FIRM panels. December 2018 coastal-study revisions expanded mapped SFHAs west of I-880 and around Marina Boulevard.
Construction, location, extension, conversion, or alteration of any structure in the SFHA without full compliance with SLMC Chapter 7-9 is a misdemeanor. The City may order corrective work, deny Certificates of Occupancy, and report non-compliance to FEMA, which can result in NFIP suspension that would terminate federally-backed flood insurance for the entire community. Federal civil penalties under 42 U.S.C. 4012a can reach $2,000 per violation for failure to maintain required flood insurance on a federally-backed loan.
