Englewood Chapter 222 prohibits construction or alteration in special flood hazard areas without compliance, and requires substantial damage records reported to NJDEP.
Chapter 222 of the Englewood code, Flood Damage Prevention, regulates construction, relocation, extension, conversion, and alteration of structures and land within mapped special flood hazard areas. No structure or land may be constructed, relocated, extended, converted, or altered without full compliance with the chapter and other applicable regulations. The city must record and maintain flood and nonflood damage records for substantial damage structures and provide a letter of substantial damage determination to the owner and to the New Jersey Department of Environmental Protection, Bureau of Flood Control. The chapter notes the limits of the regulatory degree of flood protection and disclaims any guarantee against flooding outside mapped areas.
Building or altering structures in flood hazard areas without compliance can trigger stop-work orders, mandatory removal or modification, daily fines, and federal flood insurance consequences.
