Mahwah Chapter 27 Flood Prevention requires development permits in special flood hazard areas mapped on the August 2019 Bergen County Flood Insurance Study for Community No. 340049.
Chapter 27 of the Mahwah Township Code (Flood Prevention), most recently amended on June 27, 2019 by Ordinance No. 1878, regulates construction and development in flood hazard areas to reduce loss of life and property. A development permit must be obtained before construction begins within any area of special flood hazard, with applications showing nature, location, dimensions, elevations, proposed structures, fill, materials storage, and drainage facilities. Special flood hazard areas for Community No. 340049 are identified on the Flood Insurance Study for Bergen County dated August 28, 2019. The Planning Board hears appeals and variance requests under the chapter.
Building or filling in a flood hazard area without a permit can result in stop-work orders, removal of unlawful structures, and fines under Chapter 27 enforcement provisions.
