Mahwah's Chapter 28 Soil Management regulates excavation, grading, and drainage on private property. No person may excavate or otherwise remove soil for sale or for use other than on the lot of origin without first obtaining permission from the Township Committee, except in connection with construction or alteration of a building on the same premises. The Township evaluates applications based on soil erosion by water and wind, drainage, soil fertility, and lateral support of slopes and abutting streets. Drainage is defined to include surface runoff control to minimize erosion and sedimentation during construction.
