Owners are responsible for ensuring drainage paths function and that low spots, ponding, or eroded areas are corrected. Larger development projects must additionally comply with Chapter 268 stormwater management standards and any applicable Bergen County Soil Conservation District certification when disturbance exceeds 5,000 square feet.
Permitting soil erosion, ponded stagnant water, or unmaintained drainage on a property may result in property maintenance citations, abatement orders, and fines under the borough's code enforcement authority.
