Bergenfield's Chapter 268 sets minimum stormwater management requirements for major development, requiring green infrastructure best management practices and nonstructural strategies to maintain natural hydrology.
Adopted December 3, 2024 by Ordinance No. 24-2634 (superseding the prior Chapter 268), Bergenfield's stormwater management chapter establishes controls for major development. Projects must achieve flood control, groundwater recharge, and pollutant reduction through green infrastructure best management practices (GI BMPs) and nonstructural stormwater strategies. Goals include reducing runoff volume, preventing erosion, encouraging infiltration and recharge, and reducing nonpoint source pollution. Stormwater management measures may require recorded deed notices in the Bergen County Clerk's Office.
Performing major development without an approved stormwater management plan, failing to install or maintain required green infrastructure BMPs, or omitting required deed notices may result in stop-work orders, fines, and corrective remediation.
