Land disturbance of 1 acre or more triggers an MS4 stormwater permit under Indiana Rule 327 IAC 15-5 and requires a Stormwater Pollution Prevention Plan (SWP3). Smaller projects must still comply with erosion control and the Indiana common-enemy drainage rule as modified by IC 36-9-27 (county drain law). Retaining walls over 4 feet require a building permit and engineered plans through the Department of Business and Neighborhood Services (DBNS). Grading cannot alter the natural flow of surface water to cause damage to adjoining parcels. Regulated drains fall under the Marion County Surveyor's Office.
