Indianapolis-Marion County implements Indiana's Rule 5 Construction Stormwater (327 IAC 15-5) through DPW Stormwater Compliance and Rev. Code Ch. 671. Any construction or land-disturbing activity over 1 acre (or part of a larger common plan) requires a Notice of Intent (NOI) filed with IDEM, an approved Stormwater Pollution Prevention Plan (SWPPP), and installation of perimeter silt fence, stabilized construction entrances, and inlet protection before disturbance. Disturbed areas not active for 14 days must receive temporary stabilization. Final stabilization (70% vegetative cover) is required before NOT (Notice of Termination). DPW inspects and issues Notices of Violation; IDEM holds concurrent authority.
Missing SWPPP or controls: stop-work order plus $500 to $2,500 per day. Sediment discharge to White River / Fall Creek: IDEM penalties up to $25,000 per day. Unpaid: DPW certified lien.
