Summary
Construction sites in the Consolidated City must minimize erosion, stabilize exposed soil within set deadlines, and trap sediment with basins, silt fences or similar controls until the site is stabilized.
Land alteration which strips the land of vegetation and other land stabilizing materials, including regrading, shall be done in a way that will minimize erosion. Whenever feasible, natural vegetation shall be retained, protected and supplemented. Cut and fill operations shall be kept to a minimum to ensure conformity with existing topography so as to create the least potential erosion. Sediment in runoff water shall be trapped by the use of methods such as, but not limited to, debris basins, sediment basins, inlet protection, silt fence and silt traps until the disturbed area is stabilized.

Chapter 561's Division 5 minimum standards require land-disturbing work to protect exposed areas and minimize erosion, retaining natural vegetation where feasible. Exposed soil must be stabilized starting within 7 days of being left idle and completed within 14 days; areas inactive 15+ days need temporary stabilization. Sediment in runoff must be trapped using debris basins, sediment basins, inlet protection, silt fence or silt traps until the site stabilizes. Per Sec. 561-102, this chapter applies only throughout the Consolidated City of Indianapolis. Beech Grove, Lawrence, Southport and Speedway, which kept their own governments, are not covered.
Violations & Fines
Violations run through the same enforcement as Chapter 561's drainage-permit rules under Code Sec. 103-3, with a minimum $100 fine and each day of noncompliance a separate offense.
