Pool fencing must comply with both 5.09 and the private swimming-pool standards in 5.02(C)(7), which require an impenetrable barrier at least 4 feet high with self-closing, self-latching gates. Owners are responsible for maintenance, including repair, removal, and timely replacement of missing, damaged, or dilapidated materials (5.09(K)).
Failing to meet any 5.09 requirement — missing permit, an opaque front-yard fence, a sight-triangle obstruction, an unsecured pool barrier, or a dilapidated fence — is a UDO violation enforced by Carmel Code Enforcement. The City typically issues a notice of violation with a deadline to permit, modify, or remove the fence. Vision-clearance and pool-barrier violations are treated as safety issues. Unresolved violations can escalate to ordinance-violation citations and fines.
