Structural review and permitting of a retaining wall fall under Carmel City Code Chapter 7 (Building Code), which incorporates the Indiana building code; under the Indiana Residential Code (IRC), retaining walls supporting a surcharge or exceeding the code-exempt height generally require an engineered permit. Note that if a fence is placed on top of a retaining wall or berm, the fence height is measured from the ground adjacent to the wall/berm (UDO 5.09(E)), so a wall plus fence can affect compliance.
A retaining wall that diverts stormwater onto neighbors or obstructs natural drainage violates UDO Section 5.13 (Grading and Drainage) and can trigger a notice of violation and required corrective grading. Building a structural retaining wall that requires a permit without obtaining one is a building-code violation under Chapter 7, which can lead to a stop-work order, after-the-fact permitting, or removal. A fence mounted on a wall that pushes total height over the UDO 5.09 limit is also enforceable.
