La Porte regulates fence setbacks, maintenance, and placement through its zoning and property maintenance codes. Fences must be maintained in good repair and may not encroach on public rights-of-way or create visibility hazards.
The City of La Porte requires all fences to be maintained in good structural condition and presentable appearance under its property maintenance standards. Fences must not lean, have missing boards or sections, or show signs of significant deterioration. Fences must be set back from public sidewalks and rights-of-way and may not encroach on city property or utility easements. On corner lots, fences must comply with visibility triangle requirements to maintain sight lines at intersections. Fences enclosing front yards in residential zones are subject to additional height and transparency requirements. Barbed wire, razor wire, and electric fences are prohibited in residential zoning districts. Chain-link fences in front yards may be restricted or prohibited depending on the zoning district. All fences must be built with the structural side (posts and rails) facing the property owner's side. Property owners are responsible for maintaining fences along alleys and rear property lines. Contact Code Enforcement at (281) 471-5020 to report fence maintenance violations.
Fence maintenance violations result in a notice with a compliance deadline. Failure to repair or replace deteriorated fencing may result in fines up to $2,000 per day. The city may abate the condition and charge costs to the property owner.
